This Online Privacy Policy is published herewith to give you a better understanding of this important Policy as well as the company’s business Practices and adherence to the (EU) General Data Protection Regulation (GDPR). This Online Privacy Policy describes how we manage personal information and respect your privacy. This Policy applies to information we collect on our website(s) and through the use of our products if/when you sign up for an account in email, text, and other electronic messages between you and our website(s), including our technical support. This policy may be amended from time to time. We encourage visitors and users of our sites to regularly review our Online Privacy Policy.

“Personal Information” is defined as any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains. Personal Information includes: first and last name, home or other physical address, telephone numbers, e-mail addresses, or other contact information that is provided to us by you, or any other party. All Personal Information that we collect and maintain will be subject to this Online Privacy Policy, as amended from time to time. Commitment to Privacy

We are committed to respecting your online privacy and recognize the need for appropriate protection and management of the Personal Information” you share with us. In general, you may visit our web sites without disclosing to us who you are and without revealing any Personal Information about yourself. You should be aware that if you choose to provide us with your Personal Information, we may transfer such information, within Bihrle or to Bihrle’s third-party service providers, across borders and from your country or jurisdiction to other countries or jurisdictions around the world, subject to the limitations of this Online Privacy Policy. Bihrle strives to comply with all applicable laws around the globe that are designed to protect your privacy. Although legal requirements may vary from country to country, Bihrle intends to adhere to the principles set forth in this Online Privacy Policy.

Lawful Basis for Processing Personal Data

In processing your Personal Information in connection with the purposes described in this Policy, we rely on the legal basis of Legitimate Interest. We collect Personal Information that is necessary for managing and promoting our business, maintaining a product/service supplier to customer business relationship which includes but is not limited to; product information and marketing communication, maintaining data and network security, improving website and product performance and customer experience, and preventing fraud and malicious acts.

In addition, Direct Marketing activities using Legitimate Interest as the legal basis uses purchased contact lists or publicly available sources of information as contact sources in marketing campaigns.

Entities Collecting Personal Information

Bihrle is made up of different subsidiaries, business units or product lines (herein referred to as “Entities”) for the purpose of product/service branding or segmentation. Each Entity may have its own web site. Bihrle’s Entities include: (1) “Ardenna”, which is Bihrle’s wholly-owned subsidiary focused on computer vision and machine learning technologies, and (2) “StallBox”, which is Bihrle’s hardware/software solution for flight simulator upgrades. This Online Privacy Policy is issued on behalf of all Entities encompassed by the legal entity of Bihrle Applied Research Inc. When we refer to “Bihrle”, “we”, “us” or “our” in this Online Privacy Policy, we are referring to the relevant Entity and corresponding web site within Bihrle responsible for processing your data. The following Sites are covered by this Policy and are collectively referred to as “Site”:

Personal Information That We Collect

However, when you register to use the Site to obtain information and/or order products or services as a subscriber, we may collect the following Personal Information from you in order to provide the services to you:

• Contact information such as your name, phone and fax numbers, address and email address; and
• Demographic information such as your job title, job description and company name and company type; and
• Profile data, including your username and password, details about your purchases and the Content that you license from us.

Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

When you use the Site, Bihrle or third-party service providers contracted by Bihrle may also collect certain technical and routing information about your computer and Site access to facilitate your use of the Site and its services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, and the Internet Protocol (IP) address of your computer. We use these environmental variables to facilitate and track your use of the Site and its services. We also use such environmental variables to measure traffic patterns on the Site. To better understand the needs of our visitors to the Site we may occasionally match such information with your Personal Information.

In order to reduce errors in our database, authenticate our users, and prevent abuse of our system, we may on occasion supplement the Personal Information you submit to us with information from third-party sources. For example, we may supplement your contact information with address information provided by the U.S. Postal Service to qualify your information and prevent errors in our database. We may supplement the information that we collect directly from you with information stored in third-party databases, such as demographic information or company information in order to make it more likely that any marketing communications we send will be relevant and of interest to you. Personal Information Acquired from External Sources

Bihrle conducts outbound marketing campaigns to reach new customers. The source of the Personal Information comes from trade shows where contact information is voluntarily provided, webinar and seminar registrations, publicly available sources such as Linked-in. The processing of personal data for direct marketing purposes is carried out for legitimate business reasons.

How Your Personal Information Is Used

Bihrle collects your information in order to provide services to you, comply with our legal obligations, and to improve our products and services. We do not sell, rent or share your personally identifiable information to or with third parties in any way other than as disclosed in this Online Privacy Policy. Bihrle may use this information to:

• Send you download, order or renewal confirmations.
• Register your rights, if any, to technical support or other benefits that may be made available to registered users.
• Respond to customer service requests, questions and concerns.
• Administer your account.
• Send you requested product or service information.
• Keep you informed about special offers and services of Bihrle and selected third parties.
• Administer promotions and sweepstakes you enter and notify you of the results.
• Investigate, prevent or take action regarding illegal activities and/or violations of our Terms of Service.
• Meet our research and product/service development needs and to improve our Site, services and offerings; and
• Customize your experience, including targeting our services and offerings to you.

We store information that we collect through cookies, log files, transparent images, and/or third-party sources to create a summary of your preferences. We tie your personally identifiable information, and/or your membership usage history, to information in the summary, in order to provide tailored promotions and marketing offers, to improve the content of the site for you and/or to determine your preferences.

In certain situations, Bihrle may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Where required by law (e.g., to comply with a subpoena, warrant, court order, or legal process served on Bihrle), and when we believe that disclosure is necessary to protect our rights, avoid litigation, protect your safety or the safety of others, investigate fraud, and/or respond to a government request. We may also disclose information about you if we determine that such disclosure should be made for reasons of national security, law enforcement, or other issues of public importance.

Information Sharing with Service Providers / Agents

Bihrle may share Personal Information with certain companies that perform services on our behalf. We only share the Personal Information which is necessary for them to perform those services. We require any company with which we may share Personal Information to protect that data in a manner consistent with this Policy and to limit the use of such Personal Information to the performance of services for Bihrle. We do not sell or otherwise provide Personal Information to other companies for the marketing of their own products or services.

Updating Your Personal Information and Privacy Preferences

Upon request, Bihrle will provide you with information about whether or not we hold, or process on behalf of a third party, any of your Personal Information. You have the right to review, correct or delete your Personal Information and change your privacy preferences at any time. To request to know what Personal Information we hold or to correct or delete this information, please contact us at privacy@bihrle.com. We will respond to your request promptly within a reasonable timeframe.

Choice / Opt-Out

You may “opt out” of receiving Bihrle’s email updates, newsletters and/or partner emails by clicking on the “Unsubscribe” link within the email and making the appropriate selections. The choice to opt out of such communications is also generally available during the sign-up process. Bihrle will still contact you when there are substantive changes to the Terms of Service. In addition, we will still send you service-related announcements including, but not limited to, a registration email, benefit notification emails, emails automatically triggered by actions you took on the Site and bill related notices. Generally, you may not opt-out of these communications, which are not promotional in nature. If you wish not to receive them, you have the option of deactivating your account
Protection of Your Personal Information
The Personal Information that you provide in connection with the use of the Site is protected in several ways.

• Access by you to your account profile is available through a password and unique username selected by you. This password is encrypted. You should strive to use a strong, alpha-numeric password which you should not divulge to anyone.
• Your Personal Information resides on secure servers that only selected Bihrle personnel and contractors have access to via password.
• Your Personal Information is encrypted whenever it is transmitted to Bihrle.
• When you enter sensitive information on our registration or order forms, we encrypt that information using transport layer security technology.

We strive to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we take into account the sensitivity of the Personal Information we collect, process and store, and the current state of technology to use these measures protect your Personal Information, we cannot guarantee its absolute security.

Data Retention

We will retain your information for as long as your account is active, your information is needed to provide you services, or as required to fulfill our legal obligations. If you wish to delete your account or request that we no longer use your information to provide services to you, contact us at privacy@bihrle.com. We will respond to your request within 30 days. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Cookie and Tracking Technologies

The Site may automatically collect information as you browse, such as Internet Service Provider, browser type and version, operating system and device type, average time spent on our site(s), pages viewed, information accessed, the Internet Protocol (IP) address used to connect your computer to the Internet and other relevant statistics. Such information is sometimes referred to as web analytics and/or clickstream data.

We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, and provide site functionality.

Technologies such as cookies, beacons, tags and scripts are used by Bihrle and our affiliates and analytics services to provide site features and functionality. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may use session cookies, which terminate when a user closes his or her browser, and/or persistent cookies, which remain on the user’s computer until manually deleted. Changes in Privacy Policy

Bihrle reserves the right to amend the Online Privacy Policy from time to time at its sole discretion and will provide notice by email or on the home page of the Site when we make material changes to this Online Privacy Policy prior to the change becoming effective. If as the result of such changes, you want to alter the ways in which Bihrle is allowed to use your Personal Information, you can do so by following the procedure described in the section entitled “Updating Your Personal Information and Privacy Preferences.”

You will be deemed to have been made aware of, and will be subject to, any material changes to the Online Privacy Policy after such notice has been posted with the following exception: If at the time you provide Personal Information to Bihrle you are given the opportunity (as you currently are) to limit how such information will be used to communicate with you, either by Bihrle or by third parties, Bihrle will not change your preference in this regard without your express consent. However, if Bihrle is acquired by or merged with another entity, Bihrle may provide to such entity customer information that is related to that part of our business that was sold to or merged with the other entity without your consent, but Bihrle will provide notice of such asset sales, acquisitions, or mergers on this Site.

Links to Third Party Sites

Our Site includes links to other web sites whose privacy practices may differ from those of Bihrle. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any web site you visit.

Social Media Widgets

Our web sites may include Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

Single Sign-On

Our Site does not currently use sign-in services such as Facebook Connect or an Open ID provider, which will authenticate your identity and provide you the option to share certain Personal Information with us such as your name and email address to pre-populate our sign-up form. Should we integrate such features into our Site, this Online Privacy Policy will be updated with the appropriate information.

Referral Program Emails

Our Site does not currently use referral services to tell a friend about our Site and which would ask you for your friend’s name and email address. Should we integrate such features into our Site, this Online Privacy Policy will be updated with the appropriate information.

Children

We do not intend to solicit or collect Personal Information from anyone under the age of 18. If you are under 18, do not enter information on this site or engage our services. If you believe a child of yours under the age of 18 has entered Personal Information, please contact privacy@bihrle.com to have the data removed and terminate the child’s account.

Privacy Complaints

Individuals located in certain countries, including the European Economic Area, have certain statutory rights in relation to their personal data. Subject to any exemptions provided by law, you may have the right to request access to Information, as well as to seek to update, delete or correct this Information.

To the extent that Bihrle’s processing of your Personal Information is subject to the EU General Data Protection Regulation, Bihrle relies on its legitimate interests, described above, to process your data. Where Bihrle processes certain Personal Information for Bihrle’s own direct marketing purposes, you have a right to object to Bihrle’s use of your Personal Information for this purpose at any time by emailing privacy@bihrle.com and opting out from receiving all email.

Bihrle takes its users’ privacy concerns seriously. If you believe that Bihrle has not complied with this Online Privacy Policy with respect to your Personal Information, you may contact the Online Privacy Officer at Bihrle Applied Research Inc., 81 Research Drive, Hampton, VA 23666, USA. In your letter please describe in as much detail as possible the ways in which you believe that the Bihrle Online Privacy Policy has not been complied with. We will investigate your complaint promptly.
